dc.description.abstractMakale, tümüyle yeni bir anayasa yapımının ortaya çıkardığı sorunları, özellikle günümüz Türkiye'si bağlamında ele almaktadır. Bu sorunlar, ne zaman, kimin tarafından, nasıl ve ne sınırlar içinde sorularıyla kavramsallaştırılabilir. Son soru, anayasa teorisinde ve uygulamasında çok tartışmalı bir sorun olan, mevcut anayasanın değiştirilemez hükümlerinin durumunu ortaya çıkarmaktadır.en_US
dc.description.abstractThis article deals with the problems involved in the making of a totatlly new constitution, particularly in the context of Turkey at present. The making of a new constitution, as opposed to ordinary constitutional amendments, involves such questions of when, by whom, how, and within which limits. The last point raises the highly controversial issue of the unamendable provisions of the existing constitution.
