dc.description.abstractKusurlu sorumluluk modern ceza hukukunun vazgeçilmez bir ilkesidir. Söz konusu ilke uyarınca bir kimsenin işlediği hukuka aykırı bir fiil dolayısıyla cezalandırılması için, fiil ile fail arasında psişik bir bağın varlığı da zorunludur. Bu ilişkinin tipik ortaya çıkış biçimi, fiilin bilerek ve istenerek gerçekleştirilmesini ifade eden kast iken, ceza kanunları, dikkatsiz ve özensiz davranmak suretiyle ve istemeden sebep oldukları neticeler sebebiyle de bireyleri cezalandırmakta ve bu şekilde taksirli sorumluluk ortaya çıkmaktadır. Toplumdaki tehlikeli faaliyetlerin artmasıyla birlikte, taksirli suçlara da daha sık rastlanmaktadır. Taksirli fiillerin yoğun biçimde işlenmesi, ceza hukukçularını failin psişik durumunu nazara almak suretiyle farklı taksir türleri ortaya koymaya ve bunları diğer kusur türlerinden ayırmak için ölçütler geliştirmeye itmiştir. Bu doğrultuda ortaya çıkan önemli ayrımlardan biri bilinçli-basit taksir ayrımıdır. Bu çalışmanın esas amacı bilinçli taksirin ne olduğunu ana hatlarıyla ortaya koyarak başkaca kusur türlerinden ayırmak ve bilinçli taksir konusunda bir karinenin varlığını kabulü sonucunu doğurabilecek uygulamalara dikkat çekmektir.en_US
dc.description.abstractFault-based liability is a fundamental principle in modern criminal law, which requires a psychic relation between the unlawful act and the person committing the act, for the act to be punishable. Whereas the typical type of this relation is mens rea; commitment of the act intentionally and willingly, criminal laws also punish individuals for negligently committed acts that result in unsolicited consequences, hence leading to liability for negligence. As dangerous activities in society are on the rise, negligence based crimes became more common. This led criminal lawyers to develop both different types of negligence, based on the psychic status of the individual committing the crime, and a set of criteria to differ these from other types of fault. The distinction between conscious and simple negligence is one of the key concepts developed to that end. The main aim of this paper is to present the main characteristics of conscious negligence and distinguish it from other types of fault, while focusing on some particular implementations that might result in the acceptance of a presumption of conscious negligenceen_US
