Ayıplı malı aynen iade edemeyen alıcının sözleşmeden dönme hakkı

Sözleşmeden dönme hakkını kullanmak isteyen alıcının satım konusu malı teslim aldığı günkü haliyle iade edemediği durumlarda nasıl bir yol izlenmesi gerektiği, Türk-İsviçre Hukuku’nda iade imkansızlığına yol açan sebebin ne olduğuna göre belirlenmektedir. Alıcı malda mevcut ayıp nedeniyle veya malın mücbir sebep ya da beklenmeyen hal nedeniyle malı aynen iade edemediği durumlarda dönme hakkını kullanabilmektedir. Bununla birlikte alıcı kendi kusuruyla malın aynen iadesini imkansız hale getirmiş veya malın şeklini değiştirmiş ya da üçüncü kişilere temlik etmişse sözleşmeden dönme hakkını kullanamamaktadır. Karşılaştırmalı hukukta alıcının dönme hakkını kullanıp kullanamayacağının iade imkansızlığının sebebine göre belirlenmesi eleştirilmektedir. Bunun yerine, bizim de katıldığımız, alıcının her durumda sözleşmeden dönme hakkını kullanabilmesi, fakat aynen iade edemediği edimin değerini satıcıya iade etmesi gerektiği görüşü benimsenmektedir.
