Türk hukukunda yardımcı kişilerin fiillerinden sorumluluk

Abstract

Günümüz dünyasında ekonomik ve sosyal konjonktür borçluları yardımcı kişilere başvurmaya zorlamaktadır. Tezin çalışma alanı Türk Borçlar Kanunu’nun 116. maddesinde düzenlenmiş olan yardımcı kişinin fiillerinden sorumluluk kurumudur. Tezin amacı ve asıl odak noktası Türk Hukuku (TBK 116) ekseninde sorumluluğun şartları ve tartışmalı hususlar olacaktır. Özellikle de Yargı kararları ve doktrin arasındaki çekişme sunulacaktır. Aynı zamanda İsviçre Borçlar Kanunu art. 101) ve Alman Medeni Kanunu (§278) da incelenecektir. Bu kapsamda, sayısız yargı kararı ele alınacaktır. Tezde ilk bölüm, sorumluluğu genel hatlarıyla inceleyecektir. İkinci bölümde sorumluluğun şartları sunulacaktır. Nihayet, üçüncü bölüm sorumluluğun hüküm ve sonuçlarını ortaya koyacaktır.

In the modern World, economic and social structure force obligors to receive assistance from auxiliary persons. The research subject of the thesis is related to the liability for auxiliary persons which is regulated in art. 116 of Turkish Code of Obligations. The aim and main focus of the dissertation will be the conditions of this responsibility and controversial issues on the basis of Turkish Law (TBK 116). Particularly, the controversy between judicial decisions and scholarly material/doctrine will be presented. Also, the Swiss Code of Obligations (art. 101) and the German Civil Code (§278) will be examined. In this context, numerous examples based on judicial decisions will be provided. In this dissertation, the first chapter will examine the liability for auxiliary persons in general. The second chapter will provide the conditions of this liability. Finally, the third chapter will present the provisions and consequences of the liability.
