| dc.description.abstract | Milletlerarası ticarî tahkimde tarafların eşitliği ilkesi, yargılamaya hâkim temel usûli haklardan biridir. Taraflara eşit muamelede bulunulması olarak da tanınan bu ilke, âdil yargılanma hakkı ile yakın ilişkilidir. Âdil yargılanma hakkı, Türk hukukunda Anayasal bir ilke (Türkiye Cumhuriyeti Anayasası madde 36) olup Avrupa İnsan Hakları Sözleşmesi (madde 6) ile de güvence altına alınmıştır. Çalışmamız çerçevesinde eşitliğe ilişkin farklı anlayışlar karşılaştırılmış ve usûli açıdan âdil bir dengeyi temin etmek bakımından tarafların eşitliği ilkesinin rolü irdelenmiştir. Tarafların eşitliği ilkesinin ihlâli, hakem kararının iptali sebebi olabilmekte veya yabancı hakem kararlarının tanınması ve tenfizine engel teşkil edebilmektedir. Çalışmamızda tahkim yargılamasında tarafların eşitliği ilkesinin ihlâli nedeniyle Avrupa İnsan Hakları Mahkemesi’ne başvuru şartları da tartışılmıştır. Bu tez çerçevesinde, tarafların eşitliği ilkesine ilişkin hükümler karşılaştırmalı olarak incelenmiş, ilgili yargı kararlarına ve hakem kararlarına yer verilmiştir. | en_US |
| dc.description.abstract | Principle of the equality of the parties is one of the fundamental procedural rights in international commercial arbitration. This principle, also known as the equal treatment of parties, has a close link with the right to a fair trial. The right to a fair trial, which is a constitutional principle under the Turkish law (Article 36 of the Constitution of the Republic of Turkey), is guaranteed under Article 6 of the European Convention on Human Rights. Within the scope of our study, differents perceptions of the equality are compared and the role of the principle of party equality is examined with regards to assure the procedural fair balance. The violation of the principle of the equality of the parties may constitute a ground for setting aside of arbitral award and a ground for refusal of recognition and enforcement of a foreign arbitral award. In our study, the terms of application before the European Court of Human Rights are also discussed due to the violation of priciple of party equality in arbitration. In the framework of this thesis, provisions regarding the principle of the equality of the parties are examined in a comparative approach, related court decisions and arbitral awards are included. | en_US |
