| dc.description.abstract | Sözleşme serbestisi ve bunun sonucu olarak sözleşmeye bağlılık ilkesi, modern kanunlaşma hareketlerini etrafında şekillendiren, özel hukukun en temel ilkeleri arasında yer almaktadır. Fakat sözleşme kurulduktan sonra ortaya çıkan durum değişiklikleri sonucunda sözleşme ilişkisine devamın adil olmayan sonuçlar ortaya çıkarabileceği, bilhassa dünya savaşları ve ekonomik krizler sonrasında gündeme gelmiştir. Sözleşmeye bağlılık ile sözleşme adaleti ilkeleri arasında bir uzlaşma sağlanması çabalarının sonucu olarak ise sözleşmenin değişen koşullara uyarlanması bir hukuki mekanizma olarak ortaya çıkmıştır. Türk Hukukuna öğretideki görüşler ve yargısal uygulamalar ile giren sözleşmenin değişen koşullara uyarlanması, 2012 yılında yürürlüğe giren 6098 sayılı Türk Borçlar Kanunu madde 138 hükmü ile kanuni düzenlemesine kavuşmuştur. Çalışmamızda sözleşmeye bağlılık ilkesi ve sözleşmenin değişen koşullara uyarlanması arasındaki ilişki incelenmiş, sözleşmenin değişen koşullara uyarlanmasının tarihsel gelişimi, hukuki temeli ve farklı hukuk düzenlerinde geliştirilen teoriler üzerinde durulmuştur. Türk Borçlar Kanunu madde 138 düzenlemesinin şartları ve olay grupları bağlamında kapsamı tartışılmış, sözleşmenin değişen koşullara uyarlanmasının talep edilmesinin hukuki niteliği, uyarlamanın nasıl yapılacağı ve doğuracağı hukuki sonuçlar, öğretide ileri sürülen görüşler ve yargı uygulamaları da değerlendirilerek açıklanmıştır. | en_US |
| dc.description.abstract | Freedom of contract and sanctity of contract, which have had significant effects on the modern codification movements, are among the core principles of private law. However, it was argued, especially subsequent to world wars and economic crises, that the maintenance of the contractual relationship after a change in circumstances may cause unfair consequences. Adjustment of contract to the change in circumstances propounded as a legal instrument, as a result of the efforts to reach a compromise between sanctity of contract and contractual justice. Adjustment of contract to the change in circumstances was introduced to Turkish law through the opinions of scholars and jurisprudence and regulated for the first time by Article 138 of the Turkish Code of Obligations, which came into force in 2012. In this study, the relationship between sanctity of contract and adjustment of contract to the change in circumstances is examined. The historical development and legal basis of adjustment of contract is assessed and theories developed in comparative legal systems regarding adjustment of the contract is analyzed. The preconditions of Article 138 of the Turkish Code of Obligations and its scope in the context of different groups of possible cases are discussed. Legal characteristics of a request for the adjustment of a contract, the execution of the adjustment and the resulting legal consequences are explained with an evaluation of opinions of scholars and legal practice/jurisprudence. | en_US |
