dc.description.abstractAvrupa Birliği Komisyonunun rekabet hukukundaki inceleme yetkisinin kapsamı ve bu yetkinin kullanılmasının her yönü ile ortaya konulması Türk hukuku için de büyük bir öneme sahiptir. Zira Türk rekabet hukukunun mehazı, AB rekabet hukukudur. 1/2003 sayılı Tüzük ile yeniden düzenlenen ve Avrupa Birliği Adalet Divanı içtihatları ile kapsamı şekillenen inceleme yetkisi, AB hukukunda yasaklanan rekabet ihlâllerini ortaya çıkarmakta Komisyonun en etkin araçlarından birisidir. Đnceleme yetkisinin kapsamına; özellikle inceleme yapılacak yerlerin belirlenmesi, belgelerin incelenmesi, bunların kopyalarının alınması, gerektiğinde belirli süre ile mühürleme ile koruma altında alma ve inceleme esnasında teşebbüs personelinden sözlü açıklama yapılmasını isteme girmektedir. Bu konuların her yönü ile açıklığa kavuşturulması hem uygulayıcılar hem de teşebbüsler açısından rekabet hukuku uygulamasındaki inceleme sürecini kolaylaştıracaktır. Đnceleme süreci, Komisyonun inceleme talebi veya inceleme kararı ile başlayan bir süreçtir. Bu çalışmada; inceleme yetkisinin kapsamı ile bu iki yoldan hangisinin tercih edileceği, bu tercih sonrasında incelemenin nasıl başlayacağı ve ne şekilde yürütüleceği, yetkinin sınırı ile ihlâlin müeyyideleri de dâhil olmak üzere Komisyonun inceleme yetkisi ayrıntılı bir şekilde incelenmiştir.en_US
dc.description.abstractSince the origins of Turkish competition law lie in European competition law; an analysis of the European Commission’s powers of inspection in the field of competition law; and the enforcement of those powers in all respects has significant importance for Turkish competition law as well. Powers of inspection, which were amended by Council Regulation No. 1/2003 and specified by the Court of Justice of the European Union, are one of the most effective tools of the Commission as to finding any possible infringement of the relevant articles of TFEU. Within the context of powers of inspection; specifically, determination of premises to be inspected, examination and taking copies of books or records related to the business, sealing business premises and books or records for a period of time and to the extent necessary for the inspection, and requesting oral statements of any representative or staff of the undertaking are included. Analyzing these issues aforementioned provides guidance to inspection process with respect to application of competition rules both to the practitioners and the undertakings. The process of inspection is initiated either by a request or a decision of the Commission. In this article, powers of inspection of the Commission is evaluated elaborately with reference to the choice to be made between the two methods mentioned above to initiate the inspection, the scope of powers of the Commission, the limits of powers concerned and remedies for infringements.en_US
