Milletlerarası ticari tahkim açısından çevrimiçi (online) tahkim yöntemi

Bu tez, milletlerarası ticari tahkim açısından çevrimiçi tahkim yöntemini ele almaktadır. İnternet ve iletişim teknolojilerinde meydana gelişmeler sonucu ortaya çıkan çevrimiçi uyuşmazlık çözümü yöntemlerinden biri de çevrimiçi tahkim yöntemidir. İlk etapta sınır-aşan karakterli elektronik ticaret uyuşmazlıklarının çözümü noktasında önemli bir işleve sahip olan çevrimiçi tahkim yöntemine olan ihtiyaç, güncel olarak etkisini gösteren Covid-19 pandemi sürecinde, pek çok uyuşmazlık türü bakımından kendini göstermiştir. Çevrimiçi tahkim yöntemine ilişkin yerel ve milletlerarası düzeyde özel düzenlemeler bulunmadığı için bu yöntemin uygulanabilirliği, ticari tahkime ilişkin genel düzenlemelere uygunluğu ölçüsünde mümkün olmaktadır. Bu sebeple de, çalışma kapsamında temel olarak, hem çevrimiçi tahkim yönteminin var olan hukuki yapıdaki yeri hem de bağımsız bir yöntem olarak tanınarak özel düzenlemelere ihtiyaç duyup duymadığı gibi hususların ele alınması amaçlanmıştır.

This thesis deals with the online arbitration method in terms of international commercial arbitration. One of the online dispute resolution methods that emerged as a result of developments in internet and communication technologies is online arbitration. The need for the online arbitration method, which has an important function in the resolution of electronic commerce disputes with a cross-border character in the first place, has shown itself in terms of many kinds of disputes during the Covid-19 pandemic process. Since there are no special regulations on the online arbitration method at local and international levels, the applicability of this method is possible to the extent of its compliance with the general regulations on the commercial arbitration. For this reason, it is necessary to address issues such as the position of the online arbitration method in the existing legal structure and whether it needs special regulations by being recognized as an independent method or not.
