dc.description.abstractTürkiye’de günümüzde faaliyet gösteren 26 ayrı türde 84.232 kooperatif bulunmakta olup, bunların ortak sayıları toplamı ise 8.109.225’tir. Türkiye’de bulunan kooperatifl erin büyük bölümünü konut yapı kooperatifl eri ve tarımsal alandaki kooperatifl erden oluşmaktadır. Kooperatifl er alanında 1163 sayılı Kooperatifl er Kanunu (KoopK) dışında 1581 sayılı Tarım Kredi Kooperatifl eri ve Birlikleri Kanun (TarKKoopB-Kanunu) ile 4572 sayılı Tarım Satış Kooperatif ve Birlikleri Hakkında Kanun yürürlüktedir. Türk Ticaret Kanununa göre kooperatifl er aynı zamanda bir ticaret şirketidir. KoopK’da yönetim kurulu üyeliğinin kazanılması ve yitirilmesine ilişkin toplu ve düzenli hükümler bulunmamaktadır. KoopK m. 90 kapsamında ilgili bakanlıklara, kooperatifl er ve üst örgütler ile bunların iştiraklerinin yönetim kurulu üyeleri ile üst düzey yöneticilerinin görevlerine, kanunda belirtilen şartların varlığı halinde, tedbir amaçlı son verilebilme yetkisi verilmiştir (KoopK m. 90/3). Çalışma kapsamında yöneticilerin görevden alınması ve bununla bağlantılı olarak kooperatifl erde teftiş ve denetim konusu öncelikle genel nitelikteki KoopK ve devamında özel nitelikteki kanuni düzenleme olan TarKKoopB-Kanunu hükümleri çerçevesinde incelenecektir.en_US
dc.description.abstractThere are 84.232 cooperatives that are active in Turkey in 26 different types, with 8.109.225 companions in total. Most of the cooperatives in Turkey are in the form of housing cooperatives and agricultural cooperatives. The laws currently in force governing cooperatives are Law No. 1163 of Cooperatives, Law No. 1581 of Agricultural Credit Cooperatives and Associations, and Law No. 4572 of Agriculture Sales Cooperatives and Associations. According to Turkish Commercial Law, cooperatives are also commercial partnerships. In the Law of Cooperatives, collective and systematic rules regulating the attainment and loss of membership in the administrative board do not exist. Article 90 of Law of Cooperatives authorizes relevant ministries to terminate board memberships and remove senior executives of cooperatives, associations and their privities as a precautionary measure, when the conditions laid down in the law are realized (Art. 90/3). In this paper, removal of members of administrative board and directors, and consequently the matter of supervision and audit in cooperatives will be examined within the framework of Law of Cooperatives, and more specifically, Law of Agricultural Credit Cooperatives and Associations.en_US
