dc.description.abstractSuç ve cezada kanunilik ilkesine uygun olarak işkence suçuna ilişkin dogru bir tanım yapılması gereklidir. İşkence suçu, Türk Ceza Kanunu'nun 94. maddesinde öngörülmüştür. Bununla birlikte, hükümde yer verilen bu düzenleme, kelimenin tam anlamıyla belirsizdir ve işkence olarak nitelendirilebilecek muhtemel ihlaller bakımından caydırıcı olmaktan uzaktir. İşkence tanımı ihtilaflı bir konu olmakla birlikte, hukuki giivenlik ve uygun hukuki koruma saglanabilmesi için belirgin bir tanıma ihtiyaç vardir.en_US
dc.description.abstractIn harmony with the principle of legality of crimes and punishment the concept of torture deserves an accurate legal definition. Torture as a crime is stipulated under the Art. 94 of the Turkish Criminal Code. However, the legal definition foreseen under that provision is by all means indistinct and definitely is not convenient to discourage any possible offences that could be described as torture. It is true that defining torture is controversial, but legal certainty and a proper legal protection require an explicit definiton.en_US
