dc.description.abstract4054 Sayılı Rekabetin Korunması Hakkında Kanun’un, Rekabet Kurulu’nun kararlarına esas teşkil edebileceği ispat usullerine yönelik olarak açık ve kesin düzenlemelere bünyesinde yer vermemi, olması nedeniyle, meselenin farklı hukuk disiplinlerinin yerleşik kurallarının karşılaştırılması yoluyla ele alınması ve çıkan sonucun, ülkemiz mevzuatına mehaz veya örnek teşkil eden hukuk düzenleriyle karşılaştırmalı bir şekilde, Rekabet Kuruluşnun içtihadi yaklaşımı ile ne ölçüde örtüştüğünün tespitinin yapılması, konuya yönelik mevcut durumun fotoğrafının çekilmesi için en uygun yöntem olarak karşımıza çıkmaktadır. İş bu çalışma bu amaca hizmet etme niyetindedir ve iş bu çalışma kapsamında genel olarak rekabet hukuku soruşturmalarında ispat kavramları tartışılacak, kimi özel rekabet hukuku ihlali tipleri için söz konusu olan özellikli ispat meseleleri üzerinde durulacak ve bu kapsamda uyumlu eylemin ispatı üzerine mehaz Avrupa Toplulukları rekabet hukuku ve ABD rekabet hukuku disiplinlerindeki duruma ilişkin özet tespitler yapılacaktır.en_US
dc.description.abstractLaw on Protection of Competition No. 4054 does not include clear and specific provisions that set out the proof procedures to be followed by the Turkish Competition Authority in conducting their duties. Therefore, the most convenient method for understanding the situation in Turkey is to make a comparative study across different jurisdictional regimes, which constitute good examples for the Turkish competition law regime, in order to determine how the outcome matches with the case law practice of the Turkish Competition Board. In this respect, this study aims at providing an overview on the proof concept in competition investigations, as well as focusing on specific proof procedures for specific types of competition law infringements. To that end, an analysis on the proof of the concerted practice under European Union and USA competition law regimes will also be drawn within the scope of this study.
