İdarenin kamu hizmeti ve kolluk faaliyeti kapsamında veri işlemesi

Dijitalleşme ve modern teknolojilerle beraber veri işleme uygulamaları da gelişmiş ve veriden sağlanan fayda inanılmaz bir boyuta ulaşmıştır. Bu dijital dünyada faaliyetlerini yerine getirirken veri işleme teknolojilerinden yararlanılması sadece özel sektör için değil, idare için de bir zorunluluk haline gelmiştir. Ancak veri işleme faaliyeti kamu hizmeti ve kamu düzeninin sağlanması açısından önemli bir yere sahip olsa da veri işleme faaliyetlerinin kişi hak ve özgürlüklerini ihlal etme tehlikesi bulunmaktadır. Her ne kadar veri işlenmesi ve bundan dolayı ortaya çıkabilecek problemler özel hukuk boyutuyla geniş çalışma alanı bulsa da kanımızca bu konu idare hukuku perspektifinden, özel hukuka kıyasla, yeterince incelenmemektedir. Bu bağlamda, tezde idarenin kamu hizmeti ve kolluk kapsamında gerçekleştirdiği veri işleme faaliyetleri ile bu faaliyetlerden dolayı ortaya çıkabilecek problemler incelenecektir.

Thanks to digitalization and modern technologies, the concept of data processing has developed and the benefit that can be derived from data has reached an incredible level. In this digital world, utilizing data processing technologies has become a necessity for both private and public sector (public administration). However, although data processing has an important role in the scope of public services and law enforcement, there is a risk that data processing may violate individual rights and freedoms. Even though data processing and its’s problems have been widely studied in private law, this topic is not sufficiently analyzed from the perspective of administrative law compared to private law in our opinion. In this context, this thesis will examine the data processing carried out by the public administration in the scope of public services and law enforcement as well as the problems that may arise due to these activities.
