Conventio pignoris ve rehin hakkının in rem niteliği

Abstract

Roma hukukunda aynî teminat kavramının, rehin verene ait tek ve belirli bir malvarlığı değerinin alacaklıya teslimi ile kurulan rehinden rehin verene ait güncel ve gelecekteki malvarlığı değerlerinin salt şekilsiz bir anlaşma ile rehnedildiği teslimsiz rehne dönüşümü ekseninde incelenmesi mümkündür. Roma rehin hukukunun günümüze ışık tutan en belirgin özelliği rehnin teslimsiz olarak tarflar arasındaki şekilsiz bir anlaşma (conventio pignoris) ile kurulabilmesine imkan vermiş oluşudur. Bu dönüşüm meşruiyetini, ius praetorium’un işlem hayatı pratikleri ve dönemin ekonomik gereksinimlerini dikkate alarak hukuku şekillendirmesinde bulmaktadır. Conventio pignoris’e hukukî koruma tanınması, rehin hakkının bir aynî hak (ius in rem) olarak karşımıza çıkmasında da büyük önem taşımaktadır. Nitekim rehin hakkının gerektiğinde malike ya da malın bulunduğu üçüncü kişilere ileri sürülmesi imkanı ius praetorium tarafından tanınan koruma yöntemleri ile ortaya çıkmıştır. Özellikle interdictum Salvianum ve daha sonra interdictum Salvianum’un genişletilmesi sonucu ortaya çıkan actio Serviana sonucunda rehin hakkı sahibinin talep hakkını üçüncü kişilere yöneltebileceği kabul edilmiş; rehinli alacaklı rehin konusu malı mal o anda kimin elinde ise ondan alarak borcun ödenmemesi durumunda alacağını elde edebilmiştir. Bu kapsamda söz konusu çalışma Roma hukukunda taraflar arasında kurulan şekilsiz rehin anlaşmasına (conventio pignoris), bu anlaşmanın zamanla hukuki koruma altına alınmasına ve bu hukuki korumaların rehin hakkının sınırlı aynî hak olarak tanınmasındaki rolüne odaklanmış olup, Roma rehin hukukundaki dönüşümün ve sebeplerinin altını çizmeyi amaçlamaktadır.

The concept of real security in Roman law can be analyzed from a perspective of transformation from a possessory pledge on a single specified asset into a non-possessory pledge over the pledger’s actual and future assets. The most important characteristic of Roman law of pledge – which is also relevant today- is how it enabled to grant a pledge over the tangible or intabgible assets solely by an informal agreement (conventio pignoris), without the necessity to transfer the possession. This legal transformation owes its legitimacy to ius praetorium and how it sculpted the strict law in the face of transactional practices and the economic conjuncture. The process whereby Roman law provided legal protection to conventio pignoris is cruical in understanding the pledge as an in rem right. Indeed, the relative opportunity to recover the pledged assets from the owner or the third parties with an actio in rem has been reached through the praetorian remedies, especially the interdictum Salvianum and actio Serviana as its expansion. Accordingly this paper is focused on conventio pignoris as the informal pledge agreement between the parties, on its relative protection provided by the praetorian remedies, and their role in understanding the Roman pledge as an in rem right. As such, it is aimed to underline the transformative process in Roman law of pledge and the causal relations that lie behind.
