| dc.description.abstract | Bu tez, yatırım uyuşmazlıklarının çözümü bakımından yatırım mahkemesi sisteminin kurulması önerisi ve diğer öneriler kapsamında ıslah çalışmaları ile sistemdeki mevcut sorunların ortaya koyulmasını amaçlamaktadır. Yatırımlara ilişkin hukuki rejim büyük ölçüde yabancı yatırımcılar lehine kurgulanmış olup, yatırımlara ilişkin tek bir düzenleyici otorite ve uyuşmazlık çözüm mercii yoktur, ki bu durum mevcut sisteme yönelen ağır eleştirilerin kaynağıdır. Ev sahibi devlet ile yabancı yatırımcılar arasında denge sağlanırken karşılaşılacak sorunlar ve yatırım reformu önerileri bu tezin konusunu teşkil etmektedir. Bu bakımdan tezde çok taraflı daimî bir yatırım mahkemesinin kurulması önerilmektedir. Bu çalışmada ilk olarak yatırım tahkimi sistemine yöneltilen eleştiriler ve mevcut sistemin aksaklıkları tartışılacak, ardından uluslararası örgütlerce yürütülen ıslah çalışmaları incelenecektir. Çalışma, yatırım mahkemesinin kurulması önerisi ve mevcut sistem ile ilgili tespitlerimiz ve çözüm önerileri ile tamamlanacaktır. | en_US |
| dc.description.abstract | This dissertation seeks to explore investment reforms such as establishing a multilateral investment court and other reform options. It could be asserted that current investment law regime tends to be a pro-investor system and there is no single regulatory authority regarding dispute resolution system, which is the source of heavy critics towards current investment regime. This mechanism requires reform in international investment law. This dissertation focuses on the problems arising out of investor state dispute settlement in terms of establishing delicate balance between investor and host state and investment reform movements conducted by different international organizations and institutions. In this respect, this dissertation suggests to establish a multilateral permanent investment court. The dissertation firstly focuses on critics regarding current arbitration framework, then it addresses international organizations’ reform options and possible structure of multilateral investment court regime. We conclude the dissertation with our findings and recommendations in relation to the current system as well as investment reform options. | |
