Turgut Tan tanıklığında 1982 anayasasının hazırlanma süreci

Abstract

1980 darbesi sonrasında Türkiye, siyasi, ekonomik ve toplumsal sorunlarını çözmek amacıyla yeni bir anayasa oluşturma sürecine girdi. Bu süreçte, dönemin siyasi istikrarsızlıkları, ekonomik sorunlar ve toplumsal çalkantılar, yeni bir anayasa ihtiyacını doğurdu. Askeri yönetim altında hazırlanan bu anayasa, geniş çapta uygulanan politik kısıtlamalar ve sıkıyönetim koşulları ile karakterize edilen yarı-otoriter bir yönetim sistemine geçişi sağladı. Anayasa taslağının oluşturulmasında kurucu meclisin rolü ve bu süreçteki temel dinamikler 1982 Anayasasının İdare bölümünü düzenleyen Turgut Tan’ın görüşleri ve anılarıyla ele alınarak, anayasanın son hali ve referandum süreci incelendi.

After the 1980 coup, Turkey embarked on a process to create a new constitution to address its political, economic, and social issues. The political instability, economic problems, and social turmoil of the period necessitated a new constitution. Drafted under military rule, this constitution facilitated the transition to a semi-authoritarian system characterized by widespread political restrictions and martial law conditions. The role of the constituent assembly in drafting the constitution and the fundamental dynamics of this process are examined through the perspectives and memoirs of Turgut Tan, who regulated the Administration section of the 1982 Constitution. The final version of the constitution and the referendum process are also analyzed.
