Regulated in the Turkish Civil Code, legal name makes up a significant part of personal rights. Women having the right to go only by their own surname after they marry was made possible by the Turkish Constitutional Court’s decision, declared on the 22nd of February. The starting point of this crucial acquisition in the Turkish Republic finds its roots in the Turkish Civil Code, dated 1926, article 153. In 1997, the related article was amended by the law no 4248, making it a legal right that women can hold their own surnames, before the surname of their husbands on the condition that they file an application. Following this amendment, there have been appeals to both the European Court of Human Rights and Turkish Constitutional Court.
