    Authoritarian populist turn and market capture in Turkey: the political economy of public procurement

    The state’s economic role has become more visible, beyond regulatory features, since the 2008 global financial crisis. In several cases, the new interventionist turn goes parallel to the authoritarian populist turn in international politics. Although the two processes have their own dynamics, they are still interrelated. Rather than abolishing the façade of the market economy, right-wing authoritarian populist leaders are more likely to capture the market through politically loyal economic actors. To this end, public procurement is one of the fundamental mechanisms to allocate resources. In this paper, we tested this argument in the case of Turkey by examining all public procurement deals (867,260 in total) between 2010 and 2019. We found that over a relatively short period of 10 years, the level of competitiveness, measured by the effective number of companies that receive public procurement, has decreased substantively. We also showed that the decrease in competitiveness was not limited only to the highest level of procurement deals. Across all deciles of procurement deals, competition has decreased, especially after 2013 – and this trend has continued since then.

    International diffusion of regulatory governance: EU actorness in public procurement

    This paper attempts to go beyond actor-centered explanations of the European Union's (EU) presence in regulatory politics by examining the role of the EU in the diffusion of regulatory norms and practices. We explore the international diffusion of public procurement policy, to which multiple organizations and especially the EU and the World Trade Organization have made an active contribution. Using the “opportunity-presence-capability” scheme, we argue that the EU is actively co-shaping the global agenda on public procurement, mainly as a result of the “opportunity” and “presence” dimensions of its global actorness and its role in the horizontal diffusion of public procurement regulations between international organizations. For “EU as a global actor” literature to offer valuable explanations, an in-depth analysis of its relationship with other international organizations, such as the World Trade Organization, reveals significant interactions and the co-shaping of policy agendas. © 2017 John Wiley & Sons Australia, Ltd

    Türk Ceza Hukukunda ihaleye fesat karıştırma suçu

    Devletin harcama ve gelir getirici işlemlerinden olan kamu ihaleleri, devleti doğrudan ilgilendirmelerinin yanı sıra ekonomik ve sosyal boyutları dolayısıyla hem ihaleye katılan isteklileri hem de toplumun genelini doğrudan ya da dolaylı olarak etkilemektedir. Bu sebeple kamu ihaleleri yasal düzenlemelere, ilgili düzenlemelere aykırılıklar ise kanuni şartların gerçekleşmiş olmasına bağlı olarak idari ve cezai yaptırımlara tabii tutulmaktadır. Kamu ihalelerinin düzenlendiği temel iki kanun 2886 sayılı Devlet İhale Kanunu ve 4734 sayılı Kamu İhale Kanunudur. Kamu ihalelerine ilişkin usul, esas ve ilkeler belirlenerek kamu ihalelerinin işleyişi yasal bir zemine oturtulmuştur. Kamu ihalelerinin hukuka ve kanuna uygun olarak yürütülmesini teminen 5237 sayılı Türk Ceza Kanunu kapsamında ihaleye fesat karıştırma suçuna yer verilerek ihale sürecinde meydana gelecek birtakım fiiller cezai yaptırıma bağlanmıştır. Çalışmamızdaki temel amaç devleti ekonomik ve sosyal açıdan büyük ölçüde etkileyen ve ilgilendiren kamu ihalelerindeki usulsüzlüklerin ve dolayısıyla da ihaleye fesat karıştırma suçunun incelenmesidir. Bu doğrultuda ilk olarak kamu ihalelerinin tarihsel ve kavramsal çerçevesine yer verilecek, daha sonrasında ise usulüne uygun ihale süreci ve bu süreçte uyulması gereken ilkelerle sakınılması gereken yasaklı davranışlar incelenecektir. En nihayetinde ise ihaleye fesat karıştırma suçu detaylı olarak irdelenecektir.
