Item Open Access Bir klasik eser olarak Carl Schmitt'in "Anayasa Öğretisi"(İstanbul Üniversitesi, 2015) Göztepe, EceCarl Schmitt’in 1928 tarihli “Anayasa Öğretisi” kitabı, yayınlandığı dönemde üzerinde çok tartışılan bir kitap olduğu gibi, bugün de hâlâ güncelliğini korumaktadır. Fransız Devrimi’yle kurulan burjuva hukuk devletinin anayasakoyucu iktidar olarak halkın siyasal temsil talebiyle ilişkisini, 19. yüzyılın çağdaş Batı devletlerini esas alarak inceleyen Schmitt, hukuk devleti ile demokratik devlet ilkesinin her zaman birbiriyle uyumlu bir ilişki içinde olmadığını göstermektedir. Buna karşılık Schmitt, Weimar Anayasası’nın değiştirilemez ilkeler içermemesine ve sadece nitelikli çoğunlukla anayasa değişikliği yapılmasını öngörmesine rağmen, pozitif anayasa kavramından yola çıkarak, halkın varoluşsal siyasal tercihlerinin değiştirilemez bazı anayasal ilkelerin varlığını kabulü zorunlu kıldığını ileri sürmektedir. Schmitt’in “klasik” sıfatını hak eden bu eseri, devrim ve darbe ya da toplumsal dönüşüm ikiliğinde sıkışan ve anayasal krizler yaşayan toplumların anayasal sorunlarına çözüm arayışında eşsiz bir hazine niteliği taşımaktadır.Item Open Access Carl Schmitt and the analogy between constitutional and international law? are constitutional and international law inherently political?(Cambridge University Press, 2013) Vinx, L.According to Carl Schmitt, constitutional law and international law are analogous in that they are both forms of political law. Schmitt concludes that neither is open to legitimate judicial enforcement. This paper critically explores Schmitt’s analogy between constitutional and international law. It argues that the analogy can be turned against Schmitt and contemporary sceptics about international law: Since we no longer have any reason to deny the judicial enforceability of domestic constitutional law, the analogy now suggests that there is no reason to think that legitimate judicial enforcement of international law is impossible.Item Open Access Ernst-Wolfgang Böckenförde and the politics of constituent power(Routledge, 2018) Vinx, L.It is often held that the legitimacy of a democratic constitution depends on its production by constituent power. This paper argues that the notion of legitimation by constituent power faces a dilemma: if the authenticity of an exercise of constituent power depends on conformity to existing constitutional law or on requirements of justice that are antecedent to the actual process of constitution-making, the appeal to constituent power must lack the paramount normative significance that theorists of constituent power attribute to it. Defenders of constituent power typically respond to this problem by radicalising the notion of constituent power. But if exercises of constituent power are to be unbound from all antecedent normativity, it is argued here, they cannot legitimate the constitutional product. This case against excessively strong conceptions of popular sovereignty is developed through a critical discussion of Ernst-Wolfgang Böckenförde’s and Carl Schmitt’s theories of constituent power.Item Open Access Reading Carl Schmitt: a theory of the state(2000) Şahin, YeldaThis thesis critically analyses some selected works of Carl Schmitt in order to open up new debates in the theory of state. The nature of the state and the ways through which it governs society is the main theme that has been dealt with in this thesis. Carl Schmitt's theoretical concepts are examined and interpreted with respect to this question on the state. This thesis argues that Carl Schmitt's theory of the state provides political theory with new theoretical insights in studying the actual life of the state and his concepts are worth analysing to understand how modern societies are governed.
