Avrupa Konseyi'nin kurulmasmm ardından kabul edilen Avrupa insan Hakları Sözleşmesi, temel hak ve ozgürlüklerin ihlal edilmesini onleyici bir takım koruyucu organlar içeriyordu. Bunlardan biri Avrupa İnsan Hakları Komisyonu, digeri de Avrupa insan Haklan Divanıydı. Ancak, hem fertlerin Komisyona bireysel başvuruda bulunabilmeleri, hem de Divanın yargı yetkisini kullanabilmesi, bunlan kabul eden devletler için mümkündü. 4 Aralık 1961 tarihinde CHP Milletvekili Nihat Erim bir kanun teklifi ile Türkiye Cumhuriyetinin bu yetkileri tanımasını onerdi. Ne var ki, kendi partisinin karşı çıkması üzerine teklifi geri çekmek zorunda kaldı. Her ne kadar, aynı teklifi AP Milletvekili Faruk Sükan üstlendi ise de, 12. Donem içinde gorüşülüp kabul edilmedigi için kadük oldu.

The European Convention on Human Rights, adopted after the establishment of the Council of Europe, was comprised of some protective organs in order to prevent violation of human rights. Two of these organs were the European Commission of Human Rights and the European Court of Human Rights. However, individuals could lodge complaints to the Commission, also the Court could exercise its juridicial power over the states which recognized this jurisdiction. Deputy of the Republican People's Party Nihat Erim proposed a bill in order to adopt the Republic of Turkey jurisdiction of the Commission and the Court. Nevertheless, Erim had to withdraw his proposal upon the opposition of the Republican People's Party. Even though the proposal was assumed by Faruk Siikan who was the deputy of the Justice Party, it deemed null and void since the bill was not deliberated and adopted during the 12th legislative term of the parliament.
