dc.description.abstractİsviçre Borçlar Kanunu’nda olduğu gibi, tek satıcılık sözleşmesinde müşteri tazminatına ilişkin herhangi bir düzenleme, Borçlar Kanunu’muzda da yer almamaktadır. Bu nedenle doktrinde çeşitli tartışmalara sebep olan bu husus, İsviçre Federal Mahkemesi’nin 2008 tarihli ATF 134 III 497 kararıyla çözüme bağlanmış ve acentelik sözleşmesi için İsviçre Borçlar Kanunu’nda 418u maddesiyle öngörülen çözümün, kıyasen tek satıcılık sözleşmelerine de uygulanması gerektiği ifade edilmiştir. Bu şekilde, tek satıcılık sözleşmelerinin sona ermesinde de müşteri tazminatı ödenmesinin yolu açılmıştır.en_US
dc.description.abstractBoth the Swiss Code of Obligations and the Turkish Code of Obligations do not contain any provision concerning “goodwill indemnity” (Kundschaftsentschädigung / indemnité de clientèle) at the end of an exclusive distributorship agreement. This point, that has been subject to doctrinal controversies, has been resolved by the Swiss Federal Court in Case ATF 134 III 497 of 2008 and the application by analogy of Article 418u of the Code of Obligations, that provides for agency agreements, to exclusive distributorship agreements has been accepted. Thereby, the Swiss Federal Court paved the way for goodwill indemnity at the end of exclusive distributorship agreements.
