Türk Medeni Kanunu ile ivmelenen toplumsal çağdaşlaşma süreci ile birlikte kadının sosyoekonomik anlamda, iş hayatındaki yerinin gelişimi araştırılmaya değer bir başlıktır. Bu tez kapsamında; üst düzey kadın hâkimlerden biri olan Ayla Perktaş ile ilgili belgelerden, yayınlardan ve kendisi ile yapılan röportajdan elde edilen hatıra ve görüşlerden yararlanılmıştır. Perktaş’ın özel hayatı ve mesleki geçmişi temel alınarak Türk adalet sisteminde tarihsel açıdan kadının yeri araştırılmıştır. Anayasa Mahkemesi üyeliğine kadar yükselen Ayla Perktaş’ın kariyer basamaklarında bir kadın olarak karşılaştığı zorluklar ve davalara bir kadın hâkim olarak bakışı ve kararları incelenmiştir. Ayla Perktaş örneğinden hareketle Türk yargısında kadın hâkim oranları ve etkinliğinin yıllar içerisinde gelişimi, uluslararası yargı sistemleri ile karşılaştırılarak değerlendirildiğinde, bu sürecin oldukça zorlu ve çalkantılı olduğu görülmektedir. Bu araştırma sonucuna göre, kadınlar için toplumsal gelişim ve eşitliğin elde edilmesinin uzun, mücadele ve özveri gerektiren bir süreç olduğu görülmektedir.

With the social modernization process that accelerated with the Turkish Civil Code, the development of women's place in business life in socioeconomic terms is a topic worth researching. Within the scope of this thesis; many documents and publications about Ayla Perktaş as one of the top female judges, as well as the memories and opinions obtained from the interview with her, were used. Based on Perktaş's private life and professional background, the historical place of women in the Turkish justice system has been investigated. The difficulties faced by Ayla Perktaş, who rose to the membership of the Constitutional Court as a woman in the career steps, as well as her vision and decisions in cases were investigated as a female judge. Based on the Ayla Perktaş instance, when the development of female judge rates and effectiveness in the Turkish judiciary over the years is compared with the international judicial systems, it is seen that this process has been quite difficult and turbulent. According to the results of this research, it is observed that social development and achievement of equality for women is a long process that requires struggle and selflessness.
