Bursa Barosu tarihi ve çevrenin korunmasıyla ilgili çalışmaları

Bu projenin amacı Bursa Barosu'nun tarihsel olarak incelemek ve baronun Bursa şehri ve çevresindeki tarihi ve doğal güzelliklerin korunmasında oynadığı rolü araştırmaktır. Bu amaç doğrultusunda öncelikle Osmanlı İmparatorluğu’nda modernleşmeyle birlikte baroların ortaya çıkmasına sebep olan etkenler, Cumhuriyet Türkiye’sinde baroların durumu ve son yüzyılda tarihin akışı çerçevesinde geçirdikleri değişimler incelenmiştir. Böylece Türkiye’deki hukuk sisteminde baroların konumları, işlevleri, yetkileri ve Türkiye’de baroların siyasi durumları açıklığa kavuşturulmuştur. Daha sonra bu genel çerçevenin içerisinde Bursa Barosu’ nun kuruluşu ve gelişimi incelenmiştir. Tarihçe kısmı bitirildikten sonra Bursa Barosu’nun incelenmeye değer olduğunu bize düşündüren özelliği olan Bursa çevresinin korunmasındaki rolü üzerine düşülmektedir. Daha sonra Bursa Barosu’nun çevrenin korunması ile ilgili rol aldığı en önemli davalardan üçü olan Cargill Davası, Orhaneli Termik Santrali Davası ve Myrleia Antik Kenti Davası belirlenen kapsam çerçevesinde araştırılmıştır. Bunun için davalarla ilgili resmi dava dosyalarından, gazete haberlerinden ve özellikle Cargill davası’nda bizzat çalışmış olan Av. Okan Dursun ile yapılan röportajdan faydalanılmaktadır.

The main purpose of this research project is to investigate the historical perspective of the Bar Association of Bursa and its role in preserving Bursa and its historical and natural wonders. To this end, beginning with the factors on the emergence of Bars along with modernization of Ottoman Empire, its conditions in the Turkish Republic, and transformations it has been through in the course of history throughout the late century is examined. Thus, the position of Bars in the Turkish judicial system along with its functions, authorizations and its political situations in Turkey has been clarified. Later on, in the general framework, establishment and progress of Bar Association of Bursa has been examined. After finishing the history part, we have focused on Bar Association of Bursa’s role in the preservation of the environment, which is very characteristic of the bar association that we thought needs to be mentioned. Afterward, we have examined some of the most significant cases of the Bar Association of Bursa that are related to protection of the environment; The Cargill Case, Thermal Reactor of Orhaneli Case and Myrleia Ancient City Case. For this purpose, we interviewed with Attn. Okan Dursun, who has personally worked on official case files, news, and especially in Cargill Case.
